Photo Licence & Usage Terms

All photographs published, displayed, sold or supplied by Bike Park Photo are protected by copyright. Copyright and all associated intellectual property rights remain with me, the photographer, unless expressly agreed otherwise in writing.

The purchase, download or receipt of a photograph grants only the usage rights expressly set out in these terms.

1. Personal Use

Purchased photographs are licensed for personal, non-commercial use only.

Permitted uses include:

• Publication on personal social media accounts.

• Personal websites and profile images.

• Printing for private display.

Photographer credit is appreciated but does not extend or alter the rights granted under this licence.

Use in connection with advertising, sponsorship, brand promotion or any other commercial activity is excluded, regardless of the platform or account used.

2. Watermarked Images and Previews

Watermarked photographs displayed on product pages, galleries or purchase interfaces are provided exclusively for viewing and selection purposes.

No licence is granted for the reproduction, publication, distribution or use of watermarked previews.

The following are expressly prohibited:

• Downloading, copying or capturing previews for subsequent use.

• Publishing or sharing previews on any website, social media platform or other medium.

• Removing, concealing, cropping or altering watermarks or copyright notices.

• Using software, AI or other methods to remove or circumvent watermark protection.

• Any personal, commercial or promotional use of preview images.

The purchase of a photograph does not grant any rights over its watermarked preview.

3. Commercial Use

All commercial use requires prior written authorisation.

Commercial use includes, without limitation:

• Use by bike parks, event organisers, brands, manufacturers, retailers or sponsors.

• Advertising, marketing and promotional activities.

• Publication on commercial websites or social media accounts.

• Use in promotional materials, publications or third-party campaigns.

Participation in an event, ownership of depicted equipment, appearance within a photograph or provision of venue access does not confer any usage rights.

Attribution or photographer credit does not constitute permission for commercial use.

4. Artificial Intelligence

The use of any photograph in connection with generative artificial intelligence or AI-based image manipulation is expressly prohibited.

This prohibition includes, without limitation:

• Generating images, artwork, posters, illustrations, video or other content derived from a photograph.

• Uploading photographs to AI generation or image manipulation services.

• AI-assisted addition, removal, replacement or modification of image content.

• Use as training data, reference material or input for AI models or generative systems.

• Creation of AI-generated derivatives, adaptations or variations.

These restrictions apply to all photographs, whether purchased, licensed, supplied or publicly displayed, and extend to both personal and commercial use.

Routine file operations, including resizing and compression, are excluded where they do not generate or materially alter image content.

5. Image Alteration

Photographs must not be altered, manipulated or incorporated into other works without prior written permission.

Reasonable cropping and resizing for permitted personal use are allowed, provided the original image is not materially changed.

The following are prohibited:

• Removal or modification of watermarks, logos or copyright information.

• Application of filters, effects or alterations that materially change the image.

• Incorporation into composites, graphics or other derivative works.

• Use in a misleading, defamatory or otherwise unlawful context.

The restrictions concerning artificial intelligence apply independently of the extent of any alteration.

6. Copyright and Licence

All photographs remain the intellectual property of the photographer.

Unless otherwise agreed in writing, purchased photographs are supplied under a limited, non-exclusive, non-transferable licence for personal, non-commercial use.

No rights are granted to sell, sublicense, redistribute or commercially exploit any photograph.

Any additional permissions must be expressly authorised in writing. Such permissions apply only to the specific uses agreed and do not constitute a transfer of copyright.

7. Unauthorised Use

Any use exceeding the permissions granted under these terms constitutes unauthorised use and may amount to copyright infringement or breach of licence.

I reserve the right to require the immediate removal of unauthorised material, revoke applicable usage permissions where legally permitted, and pursue any remedies available under applicable law.

Failure to enforce any provision on one occasion does not constitute a waiver of my rights.

8. Licensing Enquiries

Requests for commercial licensing, additional usage rights or clarification of these terms must be made directly to Bike Park Photo.

All uses not expressly permitted under these terms require prior written authorisation.
